Ownership & Title Documents
Sale Deed

The sale deed is the primary legal document for property transfer in India. It is executed between buyer and seller at the Sub-Registrar’s office and becomes solid proof of ownership once registered.
Tip: For resale properties, always insist on the original document — never accept a photocopy. Verify the property documents, survey number, and measurements match what you were told.
Parent Document

Parent documents establish the historical chain of ownership — every sale deed, gift deed, and partition deed going back 60 years to the original land grant. A clean title with no gaps means no unknown claimant can appear after purchase.
Warning: If documents are missing, transfers are undisclosed, or inheritance is unclear — do NOT proceed without a registered advocate’s opinion. Especially critical in Chennai where properties changed hands during land acquisition periods.
Encumbrance Certificate (EC)

The EC is a record of all registered transactions — mortgages, sale deeds, gift deeds, court orders, and liens — obtained from the Sub-Registrar’s Office. It proves the property is free from legal and financial encumbrances.
How to get it: Obtain Form 15 (if transactions exist) or Form 16 (nil encumbrance). The EC must cover the full period of the current seller’s ownership — ideally 30 years minimum.
Patta & Chitta
பட்டா மற்றும் சிட்டா
Patta is a government-issued revenue record identifying the legal possessor of a land parcel, issued by the VAO or Tahsildar. Chitta is an annual register maintained by the VAO showing cultivation and possession details. For apartments, land should have Patta in the builder’s/society’s name. For resale plots and houses, Patta must be in the seller’s name with survey numbers matching the sale deed.
Adangal / Field Measurement Book (FMB)
The EC is a record of all registered transactions — mortgages, sale deeds, gift deeds, court orders, and liens — obtained from the Sub-Registrar’s Office. It proves the property is free from legal and financial encumbrances.
Critical: If the Adangal shows land as ‘PORAMBOKE’ (government land), tank bed, river bed, or forest land — do NOT purchase, regardless of how many generations the seller has possessed it.
Government Approvals & Permissions
CMDA / DTCP Building Approval
Any building construction in Chennai requires prior approval from CMDA (Chennai Metropolitan Development Authority) for properties within the Chennai Metropolitan Area, or DTCP (Directorate of Town and Country Planning) for properties elsewhere in Tamil Nadu. Without approval, the building is illegal and can be demolished.
Warning: Many builders in Chennai suburbs build additional floors beyond approval. Buying such property makes you legally liable. Always cross-check the original approval number against actual floors and built area.
Land / Layout Approval (for Plots)
If buying a plot in a layout or gated community, the developer must have obtained layout approval from CMDA or DTCP, specifying total extent, number of plots, road widths, and open space reservations.
Warning: Buying a plot in an unapproved layout means you cannot legally construct, get utility connections, or secure bank loans. This is one of the most common property fraud scenarios in Chennai.
RERA Registration Certificate (Tamil Nadu)
Under the Real Estate (Regulation and Development) Act 2016, all residential projects with more than 8 units or over 500 sq.m. of development must be registered under TNRERA (Tamil Nadu Real Estate Regulatory Authority). RERA is the strongest buyer-protection law in Indian real estate.
Verify at: rera.tn.gov.in — search by project name or registration number. An unregistered project is a serious violation; report it to RERA and strongly reconsider your purchase.
Completion Certificate (CC)
Issued by CMDA or the local municipality after verifying construction was completed per the approved building plan. It confirms structural soundness and regulatory compliance. Without a CC, the building is technically incomplete — banks may refuse home loans and utility connections can be problematic.
Occupancy Certificate (OC)
Issued by the local planning authority confirming the building is safe for occupation, following a physical inspection. OC ≠ CC: the CC confirms construction per plan; the OC confirms it is safe to live in. RERA mandates builders to provide OC before handing over possession.
Your right: Insisting on the OC before paying the final installment is legally your right as a buyer under RERA.
No Objection Certificates (NOCs)
Depending on location and building type, various NOCs may be required: Fire NOC from Tamil Nadu Fire and Rescue Services (buildings above 15m), Airport Authority NOC for properties near Chennai Airport height restriction zones, Environmental Clearance for large commercial projects, and CRZ Clearance for Coastal Regulation Zone properties near ECR / OMR.
Tax & Revenue Records
Property Tax Assessment / Khata

Maintained by the Greater Chennai Corporation (GCC). Ensure all property taxes are paid up to date — any outstanding tax becomes your liability once the property is registered in your name.
Verify at: chennaicorporation.gov.in using the property’s assessment number.
Water & Electricity Connection Bills
Depending on location and building type, various NOCs may be required: Fire NOC from Tamil Nadu Fire and Rescue Services (buildings above 15m), Airport Authority NOC for properties near Chennai Airport height restriction zones, Environmental Clearance for large commercial projects, and CRZ Clearance for Coastal Regulation Zone properties near ECR / OMR.
Agreement & Financial Documents
Sale Agreement / Agreement for Sale
The preliminary contract between buyer and seller, signed before the final sale deed. It records the agreed price, payment schedule, possession date, penalty clauses for delay, and conditions of sale. Under RERA, this must be in the prescribed format for registered projects. Note: the sale agreement does NOT transfer ownership — only the registered sale deed does.
UDS Sale Deed (Undivided Share of Land)
For apartment purchases, the buyer receives an Undivided Share (UDS) of the land in addition to the constructed unit. Land appreciates over time — the building depreciates. Verify the UDS in your sale deed is mathematically correct relative to your apartment size and the project’s total built area.
Development Agreement & Power of Attorney (JDA)
Many Chennai properties are developed through Joint Development Agreements (JDA) between a landowner and a builder. The builder sells flats on behalf of the landowner using a Power of Attorney (POA). Verify that both the JDA and POA are registered and that the builder has explicit authority to sell the specific unit you are buying.
Payment Receipts & Bank Loan Closure
For resale properties, the seller must provide original payment receipts showing they paid the builder in full. If the property was purchased with a home loan, the seller must provide a Loan Closure Certificate and NOC Bond from the bank confirming the mortgage is fully discharged.
Never register the property without the bank’s NOC if the seller had a loan. The EC shows the mortgage but may not reflect recent closures — always ask for the original NOC letter from the bank.
Society & Buyer Identity Documents
Share Certificate & Society NOC
For apartment complexes with a registered RWA or cooperative housing society, the seller must provide their Share Certificate (proof of society membership) and an NOC from the society permitting the sale. This protects you from pending maintenance dues, parking disputes, or society rules that could affect your ownership.
Seller's Identity Documents
Verify the seller’s identity with Aadhaar, PAN, and one government-issued photo ID. The name in all property documents must exactly match the government ID proof. For NRI sellers, verify their passport and check TDS obligations — as a buyer, you are responsible for deducting TDS from NRI sellers.
